Probate

Estate matters often arise when someone dies without a will or living trust or with a will and without a living trust. These matters include clearing the title to real property, gaining access to bank and brokerage accounts, paying the last expenses of a deceased loved one and distributing property to the heirs of the decedent. Probate courts oversee these processes, as well as the subsequent payments for the costs of administration, including attorney fees. Our experienced attorneys represent your family through every step of the probate process to insure that all family members are treated fairly under the terms of the will and the laws of the state.

Conservatorships and Guardianships

Probate courts also conduct proceedings to supervise the conservatorships of incapacitated adults and guardianships of minors. The attorneys at Abacus Law are experienced in both of these matters overseen by the probate courts.

If you have a loved one who cannot care for him or herself or manage his or her property, you may wish to seek a conservatorship to ensure he or she receives the necessary care, and to make sure the property at issue is handled properly and according to the express or implied wishes of your loved ones. We can assist you with this process and where applicable insure that family assets are protected from Medi-Cal spend down rules for family members who may need long-term care or who may suffer from dementia or Alzheimer´s disease.

In cases where there are minor children in your family that have lost a parent or parents, we can assist your family in having your family´s choice or the parent or parents choice of guardian over the children appointed by the court.
